NOTICE OF INFORMAL APPOINTMENT OF PERSONAL REPRESENTATIVE AND NOTICE TO CREDITORS

Notice is given that an application for informal appointment of personal representative has been filed with the Registrar. No will has been presented for probate. The application has been granted.
Notice is also given that the Registrar has informally appointed Michael W. Kujawa, whose address is 1109 17th St. NW, East Grand Forks, Minnesota, 56721, as personal representative of the Estate of the Decedent. Any heir or other interested person may be entitled to appointment as personal representative or may object to the appointment of the personal representative. Unless objections are filed with the Court and the Court otherwise orders, the personal representative has full power to administer the Estate including, after 30 days from the date of issuance of letters, the power to sell, encumber, lease or distribute real estate.
Any objections to the appointment of the Personal Representative must be filed with this Court and will be heard by the Court after the filing of an appropriate petition and proper notice of hearing.
Notice is also given that all creditors having claims against the Estate are required to present the claims to the personal representative or to the Court Administrator within four months after the date of this Notice or the claims will be barred.

To join the virtual meeting, any individuals will connect using the following: zoomgov.com/join or via telephone at 1-833-568-8864 using the Judge’s meeting ID which is: 161 223 5058 passcode 536686, for the adjudication of intestacy and determination of heirship of the Decedent, and for the appointment of Dwaine Dudgeon, whose address is 1618 Dellwood Ct., Grand Forks, ND, 58201 as Personal Representative of the Estate of the Decedent in an UNSUPERVISED administration. Any objections to the petition must be filed with the Court prior to or raised at the hearing. If proper and if no objections are filed or raised, the Personal Representative will be appointed with full power to administer the Estate, including the power to collect all assets, to pay all legal debts, claims, taxes and expenses, to sell real and personal property, and to do all necessary acts for the Estate.
Notice is also given that (subject to Minnesota Statutes section 524.3-801) all creditors having claims against the Estate are required to present the claims to the Personal Representative or to the Court Administrator within four months after the date of this Notice or the claims will be barred.

SUMMONS

Amanda J. Brustad and Todd M. Brustad as Trustees of the Brustad Children’s Revocable Trust Agreement dated October 25, 2021

Estate of Russel G. Klasse, aka Russel Glen Klasse, Lorraine F. Brustad, Gene K. Klasse, Danielle Barber as Personal Representative of Estate of Norma Elaine Hesby, aka Norma Hesby, Danielle Barber, Steven C. Hesby, Jerome C. Hesby, Monica O’Brien, fka Monica Lokken, Leon J. Hesby, Billy Klasse, Pamela Klasse, Darren Klasse, also the unknown heirs of Russel G. Klasse, aka Russel Glen Klasse and any unknown successors-in-interest to any heirs of Russel G. Klasse, aka Russel Glen Klasse, claiming any right, title, estate, interest, or lien in the real estate described in the complaint herein,

This Summons is directed to: The above-named Defendants.
1. You are being sued. The Plaintiffs have started a lawsuit against you. The Complaint is attached to this Summons. Do not throw these papers away. They are official papers that start a lawsuit and affect your legal rights, even if nothing has been filed with the court and even if there is no court file number on this Summons.
2. You must BOTH reply, in writing, AND get a copy of your reply to the person/business who is suing you within 21 days to protect your rights. Your reply is called an Answer. Getting your reply to the Plaintiffs is called service. You must serve a copy of your Answer or Answer and Counterclaim (Answer) within 21 days from the date you received the Summons and Complaint.
ANSWER: You can find the Answer form and instructions on the MN Judicial Branch website at www.mncourts.gov/forms under the “Civil” category. The instructions will explain in detail how to fill out the Answer form.
3. You must respond to each claim. The Answer is your written response to the Plaintiffs’ Complaint. In your Answer you must state whether you agree or disagree with each paragraph of the Complaint. If you think the Plaintiffs should not be given everything they asked for in the Complaint, you must say that in your Answer.

4. SERVICE: You may lose your case if you do not send a written response to the Plaintiffs. If you do not serve a written Answer within 21 days, you may lose this case by default. You will not get to tell your side of the story. If you choose not to respond, the Plaintiffs may be awarded everything they asked for in their Complaint. If you agree with the claims stated in the Complaint, you don’t need to respond. A default judgment can then be entered against you for what the Plaintiffs asked for in the Complaint.

The Southwest Quarter (SW1/4) of Section Twenty-Five (25), Township One Hundred Forty-seven (147) North of Range Thirty-nine (39) West of the Fifth Principal Meridian.
NOTICE IS FURTHER GIVEN, that the object of said action is to obtain a judgment declaring that:
A. The particular Warranty Deed dated May 21, 1990 and filed for record May 23, 1990, as Document Number 500741 in the office of the County Recorder for Polk County, Minnesota, resulted in conveyance to Lorraine F. Brustad of all of Russel G. Klasse’s right, title and interest, subject only to the reserved life estate of Russel G. Klasse, in and to the real property situated in the County of Polk, State of Minnesota, and described as follows:
The Southwest Quarter (SW1/4) of Section Twenty-Five (25), Township One Hundred Forty-seven (147) North of Range Thirty-nine (39) West of the Fifth Principal Meridian.
B. Amanda J. Brustad and Todd M. Brustad as Trustees of the Brustad Children’s Revocable Trust Agreement dated October 25, 2021 are the owners in fee of the following described real property:
The Southwest Quarter (SW1/4) of Section Twenty-Five (25), Township One Hundred Forty-seven (147) North of Range Thirty-nine (39) West of the Fifth Principal Meridian.
C. The Defendants, and each of them, have no right, title, estate, interest or lien in or upon the said real property.
NOTICE IS FURTHER GIVEN, that no personal claim is made by Plaintiffs against any of the Defendants.
