Notice is given that an application for informal probate of the Decedent’s will dated May 16th, 2016 has been filed with the Registrar. The Application has been granted.

Notice is also given that the Registrar has informally appointed Steven Burris and Darci Bohn, whose addresses are 1610 Baron Blvd. Grand Forks North Dakota 58201 and 1719 S. 19th St. Grand Forks ND 58201 respectively,
as co-personal representatives of the Estate of the Decedent. Any heir or other interested person may be entitled to appointment as personal representative or may object to the appointment of the personal representative. Unless objections are filed with the Court (pursuant to Minn. Stat. 524.3-607) and the Court otherwise orders, the personal representative has full power to administer the Estate including, after 30 days from the date of issuance of letters, the power to sell, encumber, lease or distribute real estate.

Any objections to the probate of the will or appointment of the Personal Representative must be filed with this Court and will be heard by the Court after the filing of an appropriate petition and proper notice of hearing.

Notice is also given that (subject to Minn. Stat. 524.3-801) all creditors having claims against the Estate are required to present the claims to the personal representative or to the Court Administrator within four months after the date of this Notice or the claims will be barred.

A charitable beneficiary may request notice of the probate proceeding be given to the Attorney General pursuant to Minn. Stats 501B.41 subdiv. 5.

ADVERTISEMENT FOR BIDS FOR CONSTRUCT 6-UNIT T-HANGAR AT THE FOSSTON MUNICIPAL AIRPORT

Sealed bids, subject to the conditions contained herein, will be received by the City of Fosston, Fosston, MN, until 2:00 PM on Thursday, May 30, 2024. Proposals shall be submitted to the City of Fosston City Hall, 220 1st Street E, Suite A, Fosston, MN 56542. The City of Fosston administrators will meet at 3:00 PM on Thursday, June 6, 2024 to consider the bids submitted for the construction of a 6-Unit T-Hangar at the Fosston Municipal Airport. A pre-bid meeting will be held in the Fosston Municipal Airport and virtually, 32658 US Highway 2 SE, Fosston, MN on Thursday, May 16, 2024 at 1:00 PM local time. Attendance at the pre-bid meeting is highly encouraged but is not mandatory. The Fosston Municipal Airport will act on the bids on the date above specified for receiving bids or at such later time as may then be fixed. The Issuing Office for the Bidding Documents is Mead & Hunt, Inc., 2505 N University Drive, Suite 100. Fargo, ND 58102, Phone: 701-566-6450 Each bid proposal shall be made out on the form furnished by the Airport and obtained from www.questcdn.com and must be accompanied in a separate sealed envelope by either certified check drawn on a solvent Minnesota bank, a bid bond executed by a corporation authorized to contract as a surety in the State of Minnesota, or a share draft drawn on a solvent Minnesota credit union, in an amount not less than 5% of the bid amount. The bid security should be made payable to the “The City of Fosston” and must not contain any conditions either in the body or as an endorsement thereon. The bid security shall be forfeited to the City of Fosston as liquidated damages in the event the successful bidder fails or refuses to enter into a contract within ten (10) days after the award of contract and the maintenance of said work, if required, pursuant to the provisions of this notice and other contract documents. The City of Fosston will accept a bid bond approved by the Minnesota Department of Transportation and/or the United States government.

The successful bidder will be required to furnish separate performance and payment bonds in amounts equal to one hundred percent (100%) of the contract price, said bonds to be issued by a responsible surety approved by the City of Fosston, Fosston, Minnesota.
The work under this contract for this construction shall be started within ten (10) days after the “Construction Notice to Proceed” is issued. The project shall be substantially complete by 365 calendar days after the construction notice to proceed.
The following Federal Provisions apply to this bid proposal:
· Buy American Preferences (Title 49 US Code, Chapter 501).
· Minimum wage rates to be paid laborers and mechanics have been determined by the U.S. Department of Labor (DOL Regulation 29 CFR Part 5).
· This contract is subject to the provisions of Executive Order 11246 DOL Regulation 41 CFR Part 60-Affirmative Action to Insure Equal Employment Opportunity.

The specific requirements for the above Federal Provisions are incorporated by reference and are included in the U.S. Department of Commerce Economic Development Administration Standard Terms and Conditions for Construction Projects section of the Specifications. The successful bidder will be required to submit a Certification of Non-segregated Facilities and to notify prospective subcontractors of the requirement for such certification where the subcontract exceeds $10,000.

The bidder shall make good faith efforts to subcontract 2.2% DBE/MBE and 6.9% Women’s participation in workforce of the total dollar value of the prime contract to small business concerns owned and controlled by socially and economically disadvantaged individuals. The apparent successful bidder will be required to submit information concerning the DBE’s that will participate in this contract. The information shall include the name and address of each DBE, a description of the work to be performed by each named firm, and the dollar value of the contract. If the bidder fails to achieve the contract goal stated herein, it will be required to provide documentation demonstrating that it made good faith efforts in attempting to do so. A bid that fails to meet these requirements will be considered non-responsive.

INSTRUCTIONS TO BIDDERS

Engineer
Wherever the term “Engineer” appears in these specifications, it shall be understood to mean Mead & Hunt, Inc., or their duly authorized representatives, such representatives acting severally within the scope of the particular duties entrusted to them.

Owner
Whenever the term “Owner” appears in these specifications it shall mean the City of Fosston, Fosston, Minnesota.

Federal Participation Disclosure
This project will be partially funded with Federal funds from the United States Department of Commerce, Economic Development Administration and therefore is subject to the Federal laws and regulations associated with that program.

Drawings
The drawings as listed in the Special Provisions which show the details of the work specified herein, are designated the “Plans,” and form an integral part of the specifications and contract documents.

Proposals Requirements and Conditions

Prequalification:
Each bidder shall furnish the owner satisfactory evidence of his / her competency to perform the proposed work. Such evidence of competency, unless otherwise specified, shall consist of statements covering the bidder’s past experience on similar work, a list of equipment that would be available for the work, and a list of key personnel that would be available. In addition, each bidder shall furnish the owner satisfactory evidence of his/her financial responsibility. Such evidence of financial responsibility, unless otherwise specified, shall consist of a confidential statement or report of the bidder’s financial resources and liabilities as of the last calendar year or the Contractor’s last fiscal year. Such statements or reports shall be certified by a public accountant. At the time of submitting such financial statements or reports, the bidder shall further certify whether his/her financial responsibility is approximately the same as stated or reported by the public accountant. If the bidder’s financial responsibility has changed, the bidder shall qualify the public accountant’s statement or report to reflect (bidder’s true financial condition at the time such qualified statement or report is submitted to the Owner. Each bidder shall submit “evidence of competency” and “evidence of financial responsibility” to the Owner at the time of bid opening.

Proposal Quantities:
Proposals must be filled out with ink or typewriter, and without erasure, interlineations, or changes, and if not made in accordance with information for Bidders, will be subject to rejection as irregular, yet the Owner reserves the right to waive any irregularity. Unit prices must be written out in words as well as numbers.

Examination of Plans and Specifications and Site:
It is expressly agreed that by submitting a proposal the bidder acknowledges that he/she has examined the location or site of the proposed improvements and the plans and specifications and has satisfied him/herself as to the feasibility and correctness of the same and accepts all the terms and conditions thereof. Bidder must contact the airport staff to make arrangements for examining the construction site.

Proposal Preparation:
Proposal will be made in the name of the principal, and if a partnership, the names of all partners shall be given. Exact post office address shall be given in all cases.

Irregular Proposals:
Proposals shall be considered irregular for the following reasons:
a. If the proposal is on a form other than that furnished by the Owner, or if the Owner’s form is altered, or if any part of the proposal form is detached.
b. If there are unauthorized additions, conditional or alternate pay items, or irregularities of any kind that make the proposal incomplete, indefinite, or otherwise ambiguous.
c. If the proposal does not contain a unit price for each pay item listed in the proposal, except in the case of authorized alternate pay items, for which the bidder is not required to furnish a unit price.
d. If the proposal contains unit prices that are obviously unbalanced.
e. If the proposal is not accompanied by the proposal guaranty specified by the Owner.
The Owner reserves the right to reject any irregular proposal and the right to waive technicalities if such waiver is in the best interest of the Owner and conforms to local laws and ordinances pertaining to the letting of construction contracts.

Bid Guarantee:
See Advertisement for Bid for requirements and responsibility. Each separate proposal shall be accompanied by a certified check, or other specified acceptable collateral, in the amount specified in the proposal form. Such check, or collateral, shall be made payable to the Owner.

Delivery of Proposal:
Each proposal submitted shall be placed in a sealed envelope plainly marked with the project number, location of airport, and name and business address of the bidder on the outside. When sent by mail, preferably registered, the sealed proposal, marked as indicated above, should be enclosed in an additional envelope. No proposal will be considered unless received at the place specified in the advertisement before the time specified for opening all bids. Proposals received after the bid opening time shall be returned to the bidder unopened.

Withdrawal of Proposal:
A bidder may withdraw or revise (by withdrawal of one proposal and submission of another) a proposal provided that the bidder’s request for withdrawal is received by the Owner in writing or by telegram before the time specified for opening bids. Revised proposals must be received at the place specified in the advertisement before the time specified for opening all bids.

Opening of Proposal:
Proposals shall be opened, and read, publicly at the time and place specified in the advertisement. Proposals that have been withdrawn (by written or telegraphic request) or received after the time specified for opening bids shall be returned to the bidder unopened.

Disqualification of Bidders:
A bidder shall be considered disqualified for any of the following reasons:
a. Submitting more than one proposal from the same partnership, firm, or corporation under the same or different name.
b. Evidence of collusion among bidders. Bidders participating in such collusion shall be disqualified as bidders for any future work of the Owner until any such participating bidder has been reinstated by the Owner as a qualified bidder.
c. If the bidder is considered to be in “default’’ for any reason.

Award and Execution of Contract

Consideration of Proposals:
The City of Fosston, Fosston, Minnesota will proceed without unnecessary delay to consider the proposal and reserves the right to accept or reject any or all bids, to pass upon the regularity or waive any irregularities of the bidders and the acceptability of the surety offered. This is a unit price contract, and the proper extension of unit prices and the totaling of these unit price extensions shall be used in determining the apparent low bid. The Contractor must submit bid prices for all bid items associated with the bid proposal for the Base Bid. The apparent low bidder will be determined by the total for the Base Bid. The owner reserves the right to award or reject the Base Bid depending on available funds.

Award of Contract:
Since this is a Federal Aid project, the City of Fosston, Fosston, Minnesota will pass a resolution accepting the low bid, subject to Economic Development Administration (EDA) approval; said resolution shall not be binding upon the City of Fosston, Fosston, Minnesota until the EDA’s approval and authority to award the contract has been received. Award of contract may take up to 120 days from the bid date therefore the contractor shall be required to honor prices for this period.

Cancellation of Award:
The Owner reserves the right to cancel the award without liability to the bidder, except return of proposal guaranty, at any time before a contract has been fully executed by all parties and is approved by the Owner.

Return of Proposal Guaranty:
Proposal guarantees of the lowest two or more bidders may be retained until a contract is awarded or rejection made, but not to exceed one hundred and twenty (120) days after opening of bids. Other proposal guarantees shall be returned after the canvas and tabulation of bids is completed.

Contract Bonds:
At the time of the execution of the contract, the successful bidder shall furnish the Owner a surety bond or bonds that have been fully executed by the bidder and the surety guaranteeing the performance of the work and the payment of all legal debts that may be incurred by reason of the Contractor’s performance of the work. The surety and the form of the bond or bonds shall be acceptable to the Owner. Unless otherwise specified in this section, the surety bond or bonds shall be in a sum equal to the full amount of the contract.

Execution of Contract:
The successful bidder shall sign (execute) the necessary agreements for entering into the contract and return such signed contract to the owner, along with the fully executed surety bond or bonds as specified, within 15 calendar days from the date mailed or otherwise delivered to the successful bidder. If the contract is mailed, special handling is recommended.

Contract Approval:
Upon receipt of the contract and contract bond or bonds that have been executed by the successful bidder, the Owner shall complete the execution of the contract in accordance with local laws or ordinances and return the fully executed contract to the Contractor. Delivery of the fully executed contract to the Contractor shall constitute the Owner’s approval to be bound by the successful bidder’s proposal and the terms of the contract.

Failure to Execute Contract:
Failure of the successful bidder to execute the contract and furnish an acceptable surety bond or bonds within the 15 calendar day period specified, shall be just cause for cancellation of the award and forfeiture of the proposal guaranty, not as a penalty, but as liquidation of damages to the Owner.

Submittal Requirements for Disadvantaged Business Enterprise (DBE) [49 CFR Part 26]
The requirements of 49 CFR Part 26, Regulations of the U.S. Department of Transportation, apply to this contract. It is the policy of the City of Fosston, Fosston, Minnesota to practice nondiscrimination based on race, color, sex, or national origin in the award or performance of this contract. All firms qualifying under this solicitation are encouraged to submit bids/proposals. Award of this contract will be conditioned upon satisfying the requirements of this bid specification. These requirements apply to all bidders/offerors, including those who qualify as a DBE. A DBE contract goal of 2.2% has been established for this contract. The bidder/offeror shall make good faith efforts, as defined in 49 CFR Part 26, to meet the contract goal for DBE participation in the performance of this contract. A bidder or proposer who failures to show a good faith effort to achieve the specified contract goal for the participation of Disadvantaged Business Enterprises in the completion of this project will be grounds for finding the bid or proposal nonresponsive. The bidder / offeror will be required to submit the following information: (1) the names and addresses of DBE firms that will participate in the contract; (2) a description of the work that each DBE firm will perform; (3) the dollar amount of the participation of each DBE firm participating; (4) Written documentation of the bidder/offeror’s commitment to use a DBE subcontractor whose participation it submits to meet the contract goal; (5) Written confirmation from the DBE that it is participating in the contract as provided in the commitment made under (4); and (6) if the contract goal is not met, evidence of good faith efforts. Bidders / proposers will be prohibited from entering into agreements with a DBE in which the DBE promises not to provide subcontracting quotations to other bidders/proposers. Failure to carry out the DBE obligations and requirements described in the contract documents and in any reference regulations constitutes a breach of contract.

Time for Completion
The work under this contract shall be started within ten (10) days after the “Construction Notice to Proceed” is issued. Authorization of the Work to commence is anticipated by TBD, pending available federal funding. Work shall be completed by 365 calendar days.

Standard Specifications
The Standard for Specifying Construction of Airports (AC 150/5370-10H), Department of Transportation, Federal Aviation Administration, Washington, D.C., may be viewed at the office of the Engineer.
Applicable portions of the “Standards” are reproduced and contained in these Contract Documents.
Contractors desiring personal copies of these Standard Specifications may order them from the Superintendent of Documents, U.S. Government Printing Office, Washington, D.C. 20402.
a. Pay Items having numbers beginning with D, F, T, L, P, and T shall be executed under the requirements of the FAA AC 5370-10H, Standard Specification for Airport Construction.
b. Pay Items having numbers beginning with NS shall be executed under the special provisions included in the contract documents.
c. Pay Items having numbers beginning with “2…” shall be executed under the requirements of 2020 MnDOT Standard Specification for Construction.

Liquidated Damages
Liquidated damages for failure to complete the project within the specified time period shall be One Thousand Dollars ($1,000.00) per Calendar Day for each day after the time set for completion.

Right-of-Way
The Owner will furnish all property of right-of-way necessary for the construction of the project.

Payment
Payment shall be made in accordance with the General Provisions.

Minimum Wage Rates
Minimum wage rates to be paid laborers and mechanics have been determined by the Department of Labor and are listed in the Wage Rate section of the specifications.

Pre-bid Meeting
A pre-bid meeting will be held in the Fosston Municipal Airport, Fosston, MN on Thursday, May 16, 2024 at 1:00 PM Central Time.

Pre-Construction Meeting
When the low bidder has been determined and award of contract made, the Contractor, Owner, and Engineer representatives, and other interested persons will be requested to attend and participate in a pre-construction meeting. Specific details of safety requirements, maintaining air traffic, administrative details, wage rates and payroll reporting, construction procedures, construction materials, and other pertinent factors of the project will be discussed.

Construction Activities and Aircraft Operations
Project is mostly located outside of the Aircraft Operations Area (AOA) (see plans for safety notes and operations plans). The Contractor will be required to submit a detailed construction and traffic control plan at the pre-construction meeting. Work times shall be scheduled with the Airport Director.

At this meeting members shall be elected to the Board of Directors and other business shall be transacted which properly comes before the membership.
