SEPTEMBER 16, 2025 BOARD MINUTES

Pursuant to motion of adjournment, the Polk County Board of Commissioners met in regular session at 9:30 o’clock a.m., September 16, 2025. Members present: Commissioner Paul Reese, Commissioner Warren Strandell, Commissioner Joan Lee, Commissioner Gary Willhite, Commissioner Mark Holy (virtual), and Charles S. Whiting, County Administrator, Clerk of the Board. Others present: Samuel Melbye, Deputy Clerk of the Board.

AGENDA
A motion was made by Commissioner Reese seconded by Commissioner Willhite and adopted by unanimous vote of the Board to approve the September 16, 2025, agenda.

CONSENT ITEMS
A motion was made by Commissioner Willhite seconded by Commissioner Reese and adopted by unanimous vote of the Board to approve the September 16, 2025, consent items:
1. Approve September 2, 2025, Board minutes.
2. Approve Commissioner Warrants: General Revenue Fund, $41,403.50; Public Works Fund, $179,708.68; Public Safety Fund, $36,026.29; Public Health Fund, $26,574.08; Opioid Settlement, $64,956.06; Spec Assmnts (Ditch) Fund, $6,192.85; Environmental Services Fund, $10,490.41; Solid Waste, $97,624.98; Landfill Fund, $31,660.80; Per Diems, $1,875.00; Meal Reimbursements (without over-night lodging), $132.89; and Sign Audit List.
3. Approve payment to US Bank, St. Louis, MO, in the amount of $94,997.22 for procurement card purchases.

d. Participated on a panel for a solid waste discussion.
e. AMC Finance Committee meeting.
f. Minnesota African American Family Preservation and Child Welfare Disproportionality Act (MAAFPCWDA) meeting.
g. Union Lake Sarah Improvement District meeting.
4. Commissioner Willhite brought forth that he attended the following meetings:
a. Tri-Valley Opportunity Council meeting.
b. AMC meeting.
FINANCE
Stacy Grover, Finance Director, came before the Board with matters pertaining to her department:
1. Approval of Third Party Custodian Agreement with Old National Bank
A motion was made by Commissioner Reese seconded by Commissioner Willhite and adopted by unanimous vote of the Board to approve the Third-Party Custodian Agreement with Old National Bank, formerly known as Bremer Bank.

LAKE AGASSIZ REGIONAL LIBRARY
Liz Lynch, Executive Director, came before the Board with matters pertaining to the Lake Agassiz Regional Library:
1. LARL Discussion
Discussion was held with the Board regarding an update with the Lake Agassiz Regional Library.

ENVIRONMENTAL SERVICES
Jon Steiner, Environmental Services Administrator, came before the Board with matters pertaining to his department:
1. MSW Landfill Phase 15 – Release Retainage
A motion was made by Commissioner Reese seconded by Commissioner Strandell and adopted by unanimous vote of the Board to approve the release of retainage for Landfill Phase 15 in the amount of $13,207.00 for R.J. Zavoral & Sons of East Grand Forks, MN.
2. Spaleck USA Fines Screen – Payment for Freight & Tariff Costs
A motion was made by Commissioner Willhite seconded by Commissioner Reese and adopted by unanimous vote of the Board to approve the payment to Spaleck USA LLC of Manchester, NH, for the total price of the purchase of specialized, double-deck fines screen, including the adjustments for freight, tariffs, and associated fees, in the amount of $141,872.21.
3. Resolution (2025-55) Polk County CY2026 Market Price

RESOLUTION (2025-55)

Polk County CY2026 Market Price

The following resolution (2025-55) was offered by Commissioner Willhite:

WHEREAS, MS 297H.02 requires certain political subdivisions to identify by resolution a market price for solid waste management tax purposes if the political subdivision subsidizes the cost of Municipal Solid Waste (MSW) disposal at a facility, or directly bills for organized collection of MSW on property tax statements; and

WHEREAS, The political subdivision will be liable for any Solid Waste Management Tax (SWMT) based only on the market price identified by resolution; and

WHEREAS, Market price is defined in the State Statute as the “lowest price available in the area”.

NOW THEREFORE BE IT RESOLVED, That the County of Polk declares the market price for all MSW generated in Polk County during CY2026 to be $29.06 per ton, based upon the lowest price available in the area. Polk County’s identified market price includes both the cost per ton-mile for transportation and the cost per ton for disposal, assuming disposal at the Gentilly Landfill. All costs were calculated using current hauling and tip fee rates offered in the region.

Commissioner Reese seconded the foregoing resolution, and it was declared adopted upon the following vote: YEAS: Commissioner Reese, Commissioner Strandell, Commissioner Lee, and Commissioner Willhite. NAYS: None.

2026 DEPARTMENT BUDGET REVIEWS
Chuck Whiting, Polk County Administrator, came before the Board with matters pertaining to the 2026 Departmental Budgets:
1. General Overview of Budget Issues
Discussion was held with the Board regarding the 2026 budget.

HIGHWAY
Richard Sanders, Polk County Engineer, came before the Board with matters pertaining to his department:
1. County Ditch Maintenance Request
A motion was made by Commissioner Strandell seconded by Commissioner Willhite and adopted by unanimous vote of the Board to amend the agenda to add a maintenance request for CD 100. A motion was made by Commissioner Reese seconded by Commissioner Strandell and adopted by unanimous vote of the Board to approve the work in CD 28 and to name Richard Sanders, Engineer, over the project. A motion was made by Commissioner Reese seconded by Commissioner Strandell and adopted by unanimous vote of the Board to approve the work in CD 100 and to name Richard Sanders, Engineer, over the project.
2. Polk County Facilities Snow Removal – EGF
A motion was made by Commissioner Strandell seconded by Commissioner Reese and adopted by unanimous vote of the Board to approve awarding Polk County facilities snow removal in EGF to JD Construction for snow removal through May 31, 2026.
3. Review of 2026 Highway Department Budget
The 2026 Highway Department budget was reviewed and discussed with the Board. Stacy Grover, Finance Director, was also present.

**Commissioner Holy joined the meeting virtually at 11:00am.

PUBLIC HEALTH
Sarah Reese, Public Health Director, came before the Board with matters pertaining to her department:
1. Opioid Settlement Advisory Council RFP Round 2 Timeline
A motion was made by Commissioner Reese seconded by Commissioner Willhite and adopted by unanimous vote of the Board to approve the Opioid Settlement Funds Round 2 RFP process and timeline.
2. Opioid Settlement Advisory Council Documentary Impact Video
It is being recommended that Public Health create a local documentary impact video that highlights the seven grantee organizations as they share the work to which they are dedicated and the impact of settlement funds in serving their local communities. Bids were presented at the September 2025 Council Meeting, with the In-Progress bid of $8,000.00 being the recommended bid. A motion was made by Commissioner Strandell seconded by Commissioner Willhite and adopted by unanimous vote of the Board to approve the $8,000.00 In-Progress bid from the Opioid Settlement funds.

**Commissioner Holy did not rejoin the meeting after the lunch break.

VETERANS SERVICES
Kurt Ellefson, Veterans Services Officer, came before the Board with matters pertaining to his department:
1. Review of 2026 Veterans Services Budget
The 2026 Veterans Services budget was reviewed and discussed with the Board.

ENVIRONMENTAL SERVICES
Jon Steiner, Environmental Services Director, came before the Board with matters pertaining to his department:
1. Review of 2026 Environmental Services Budget
The 2026 Environmental Services budget was reviewed and discussed with the Board.

FACILITIES
Richard Langlois, Facilities Director, came before the Board with matters pertaining to his department:

ADMINISTRATION
Chuck Whiting, Polk County Administrator, came before the Board with matters pertaining to his department:

Pursuant to motion of adjournment, the Polk County Board of Commissioners met in special session at 8:00 o’clock a.m., September 17, 2025. Members present: Commissioner Paul Reese, Commissioner Warren Strandell, Commissioner Joan Lee, Commissioner Gary Willhite, Commissioner Mark Holy (virtual), and Charles S. Discussion regarding the budget summary along with reviewing the 2026 budgets was held with the Board.
2. Draft Resolution (2025-XX) Setting the Preliminary 2026 Preliminary Property Tax Levy
