TO ALL INTERESTED PARTIES, GROUPS AND PERSONS:
The purpose of this notice is to identify two separate but related actions to be taken by the City of Climax (hereinafter referred to as the Grantee).
One, the Grantee has made a Finding of No Significant Impact on project activities (see the Finding of No Significant Impact, below) and two, they propose to request the Business and Community Development Division, Small Cities Development Program, Minnesota Department of Employment and Economic Development (DEED BCD), to release Federal funds (see Notice of Intent to request Release of Funds, below) under Title I of the Housing and Community Development Act of 1974, as amended (PL 98-181) for the following project:
Climax Water Infrastructure Improvements. Define the project-The project consists of acquiring and installing meters for all water utility accounts, capping and sealing existing wells, demolition and removal of water treatment infrastructure, replace broken or leaking fire hydrants, and demolition and removal of the existing water tower. The project area is within the city of Climax. SCDP funds will be requested for activity administration, relocation and associated engineering. $546,168 and total project cost is $715,000.
Finding of No Significant Impact
It has been determined such request for release of funds will not constitute an action significantly affecting the quality of the human environment and the Grantee has decided not to prepare an Environmental Impact Statement under the National Environmental Policy Act of 1969 (PL 91-190).
The reasons not to prepare an Environmental Impact Statement are as follows:
Airport Hazards – the project area is not within 2,500 feet of civilian airports or 15,000 feet of a military airport.
Coastal Barrier Resources – the project area is not located in a coastal barrier resource area.
Flood Insurance – a floodplain was not identified in the project area, the city does have flood insurance available although it is not required for this project.
Clean Air – the project area is not within a nonattainment or maintenance area.
Coastal Zone Management – the project area is not within a Coastal Zone area.
Contamination and Toxic Substances – known contamination sites in the city limits were not located within the project area.
Endangered Species – the project area does not include critical habitats or suitable habitats for listed species
Explosive and Flammable Hazards – the project will not include a facility that handles or processes flammable or combustible chemicals.
Farmland Protection – the project area is within city limits on predisturbed ground so no farmland will be impacted or converted to a non-agricultural use.
Floodplain Management – There is no floodplain involved in the project area.
Historic Preservation – Consultation with the State Historic Preservation Office and Tribal Historic Preservation Officers supported the determination that no historic properties would be impacted by the project.
Noise Abatement and Control – the project will not address residential work, so no further evaluation is necessary for noise.
Sole Source Aquifer – the project area is not within a sole source aquifer.
Wetlands Protection – the project area does not contain any wetlands and project work will be restricted to the project area.
Wild and Scenic Rivers – the project area is not within proximity of a Wild and Scenic River, Study River or Nationwide Rivers Inventory River.
An Environmental Review Record respecting this project has been made by the Grantee that documents the environmental review of the project and fully sets forth the reasons why such statement is not required. The Environmental Review Record is on file and is available for public examination and copying, upon request, at 102 W Broadway St., Climax, MN 56523. Notice of Intent to Request Release of Funds
On or about 10/30/25, the Grantee will request the Business and Community Development Division, Small Cities Development Program, Minnesota Department of Employment and Economic Development (DEED BCD), to release Federal funds under Title I of the Housing and Community Development Act of 1974, as amended (PL 98-181) for the project described above.
Public Comments
All interested agencies, groups and persons disagreeing with this decision are invited to submit written comments for consideration by the Grantee to the 102 W Broadway St., Climax, MN 56523 on or before 11/14/25. All comments received will be considered and the Grantee will not request the release of federal funds or take any administrative action on this project before the date specified in the preceding sentence.
In addition, pursuant to the National Historic Preservation Act, comments on the identification and treatment of historic properties in the project area are welcome.
Environmental Certification
The Grantee will undertake the project described above with Block Grant funds from DEED under Title I of the Housing and Community Development Act of 1974. The Grantee is certifying to DEED that Pamela Berg, in her official capacity as Mayor, consent to accept the jurisdiction of the Federal courts if an action is brought to enforce responsibilities in relation to environmental reviews, decision making and action; and that these responsibilities have been satisfied. The legal effect of the certification is that upon its approval, the Grantee may use Block Grant funds and DEED and the U.S. Department of Housing and Urban Development will have satisfied their responsibilities under the National Environmental Policy Act of 1969.
Objections to State Release of Funds
DEED BCD will accept objections to its approval of the release of funds and acceptance of the certification for a period of fifteen days following the anticipated submission date or its actual receipt of the request, whichever is later, only for one of the following reasons: (a) that the certification was not in fact executed by the Chief Executive Officer or other officer of the Grantee approved by BCD; (b) that the Grantee’s ERR for the project indicates omission of a required decision, finding or step applicable to the project in the environmental review process; (c) the Grantee or its agents have incurred costs not authorized at 24 CFR Part 58.22 before approval of a release of funds by BCD; or (d) another Federal agency acting pursuant to 24 CFR Part 1504 has submitted a written finding that the project is unsatisfactory from the standpoint of environmental quality.
Objections must be prepared and submitted in accordance with the required procedure (24 CFR Part 58.76) and may be addressed to Manager, Small Cities Development Program, Business and Community Development Division, Minnesota Department of Employment and Economic Development, Great Northern Building, 180 East 5th Street, Suite 1200, St. Paul, Minnesota 55101-1351. Pursuant to motion of adjournment, the Polk County Board of Commissioners met in regular session at 8:00 o’clock a.m., September 23, 2025. Members present: Commissioner Paul Reese, Commissioner Joan Lee, Commissioner Gary Willhite, and Charles S. Whiting, County Administrator, Clerk of the Board. The following resolution (2025-56) was offered by Commissioner Reese:
WHEREAS, The Polk County Fair Board of Directors made a financial donation to the Polk County Sheriff’s Association in the amount of $1,000.00 to support the Polk County Sheriff’s Office; and
WHEREAS, The Polk County Sheriff’s Office wishes to have the County Board formally accept this financial donation on behalf of the Polk County Sheriff’s Office and put said donation towards a safety body bunker.
NOW THEREFORE BE IT RESOLVED, By the Board of Commissioners of Polk County, Minnesota, as follows:
1. The donation from the Polk County Fair Board of Directors, which is listed above, is hereby accepted by the Polk County Board of Commissioners on behalf of the Polk County Sheriff’s Office.

PLANNING & ZONING
Jacob Snyder, Assistant Environmental Services Administrator, came before the Board with matters pertaining to his department:
1. Tax Forfeit Demolition Project 2025
Bids were requested for the demolition of a tax forfeited home in Crookston located at 117 Washington Avenue that has been prepped for demolition. A motion was made by Commissioner Willhite seconded by Commissioner Reese and adopted by unanimous vote of the Board to approve awarding the bid to the lowest responsible bidder, Lyle Wilkens INC, in the amount of $19,749.00.
2. Final Plat – “Chalet Estates” Subdivision
Planning Commission & Staff recommend approval of the final plat for the “Chalet Estates” subdivision in section 29 of Garfield Township as the applicant has completed the conditions imposed at the preliminary plat Board meeting on September 2, 2025. A motion was made by Commissioner Reese seconded by Commissioner Willhite and adopted by unanimous vote of the Board to approve the Final Plat for “Chalet Estates” subdivision.
3. Crookston Transfer Station Concrete Pad Improvements – Change Order
A change order was submitted in the total amount of $23,940.00 to expand the square footage for the Crookston Transfer Station concrete improvements project. A motion was made by Commissioner Reese seconded by Commissioner Willhite and adopted by unanimous vote of the Board to approve the change order in the total amount of $23,940.00 for the Crookston Transfer Station concrete repairs from JD Concrete LLC of Crookston, MN, instead of the original bid proposal amount of $21,740.00.
Discussion was held with the Board regarding cannabis legislation and questions from townships concerning retail registration of businesses. Mr. Snyder discussed the process and explained that he has been working with townships on the process.

Chuck Whiting, Polk County Administrator, came before the Board with matters pertaining to his department:

WHEREAS, M.S. 275.065, sub. 1 requires local taxing authorities in the State of Minnesota to establish a proposed levy on or before September 30, 2025, for taxes payable in 2026.
NOW THEREFORE BE IT RESOLVED, By the Board of County Commissioners of Polk County that the proposed statement of expenses and anticipated receipts on file in the office of the County Administrator, for the year 2025, be and they hereby are preliminarily accepted by this Board as a proposed budget for Polk County for the year 2026 dated September 23, 2025, and that the proposed levy on the taxable property for Polk County for Year 2025 payable in 2026 be preliminarily set as follows:

4. YOU WILL LOSE YOUR CASE IF YOU DO NOT SEND A WRITTEN RESPONSE TO THE COMPLAINT TO THE PERSON WHO SIGNED THIS SUMMONS. If you do not Answer within 21 days, you will lose this case. Lot Thirteen (13), Moe’s Subdivision of SE¼ of Section 12 and NE¼ of Section 13 of Township 148, North of Range 44, West of the Fifth Principal Meridian, according to the official plat thereof on file and of record in the office of the County Recorder in and for the County of Polk and State of Minnesota.
The object of this action is to obtain the judgment of said Court determining the Plaintiffs’ title and all adverse claims to the above-described tract of land, adjudging that Plaintiffs are the owners in fee simple absolute and entitled to possession of said tract of land and the whole thereof, adjudging that the Defendants in said action, and each of them, have no right, title, claim, interest or estate in or to said tract of land or lien thereon, and adjudging such other relief as the Court shall deem proper.
